Welcome to ESV PRIME CONSTRUCTION SPECIALISTS, INC ("Company", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your use of our construction and renovation services and website. By engaging our services or using our website, you agree to be bound by these Terms. Please read them carefully.
We provide professional construction, remodeling, and renovation services including but not limited to: kitchen and bathroom remodeling, room additions, ADU construction, custom home building, plumbing services, roofing, painting, and other construction-related services as described on our website.
All projects are subject to a formal written contract that will detail the specific scope of work, timeline, materials, and pricing. No work will commence until a signed contract and initial deposit are received.
Any changes to the agreed-upon scope of work must be documented in writing through a change order and may result in adjustments to the project timeline and pricing.
All estimates and quotes are valid for 30 days from the date of issuance. Pricing may be subject to change based on material costs, labor rates, and project scope modifications.
Payment schedules will be outlined in your project contract. Typically, we require:
We accept payment via check, bank transfer, and major credit cards. A processing fee may apply to credit card transactions.
Late payments may result in work stoppage. Interest charges of 1.5% per month (or the maximum allowed by law) may be applied to overdue balances.
We guarantee the quality of our workmanship for a period specified in your project contract (typically 1-2 years). This warranty covers defects in workmanship but does not cover normal wear and tear, improper maintenance, or damage caused by third parties.
Materials and products are covered by the manufacturer's warranty. We will assist in processing warranty claims with manufacturers when applicable.
Warranties do not cover damage resulting from: acts of nature, abuse, neglect, improper maintenance, unauthorized modifications, or failure to follow maintenance recommendations.
We will obtain all necessary building permits unless otherwise specified in the contract. Permit fees are typically additional costs and will be outlined in your project estimate.
All work will be performed in accordance with applicable building codes and regulations. Any code violations discovered during the project that were not part of the original scope may require additional work at an additional cost.
ESV PRIME CONSTRUCTION SPECIALISTS, INC is fully licensed, bonded, and insured. We maintain general liability insurance and workers' compensation coverage for all our employees.
Our liability is limited to the contract price of the specific project. We are not liable for indirect, incidental, special, or consequential damages, including but not limited to loss of use, loss of profits, or inconvenience.
While we take every precaution to protect your property, construction work inherently involves some risk. We recommend that clients remove or protect valuable items from the work area. We are not responsible for damage to items not directly related to the construction work.
Clients must provide clear and safe access to the work site during normal business hours. Any delays caused by lack of access may result in project delays and additional costs.
Clients must provide access to water, electricity, and restroom facilities for our crew unless otherwise agreed upon in the contract.
Clients are responsible for making timely decisions regarding material selections, design choices, and change orders. Delays in decision-making may impact the project timeline.
Clients may cancel the contract within 3 business days of signing for a full refund. After this period, cancellation will result in charges for work completed, materials purchased, and a cancellation fee as specified in the contract.
We reserve the right to terminate a contract if: (a) the client fails to make payments as agreed, (b) the client interferes with work progress, or (c) unsafe conditions exist at the work site.
Any disputes arising from these Terms or our services will first be attempted to be resolved through good faith negotiation. If unsuccessful, disputes will be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions.
All plans, designs, specifications, and other documents prepared by or on behalf of ESV PRIME CONSTRUCTION SPECIALISTS, INC remain our intellectual property. Clients receive a license to use these documents for the specific project only.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new "Last Updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.
